Which disclosures still apply when I sell as-is?

Minnesota requires sellers to give buyers a radon disclosure, and a well disclosure statement is required when there's a well. Those remain your legal forms; we walk you through them. Ask an attorney about anything else you're unsure how to disclose.

Could you assign my purchase agreement to another buyer?

We may close with our own funds or assign the purchase agreement, and the agreement says so in writing. If it's assigned, your price, closing date, and terms don't change, and the same Minnesold contact stays with you through closing.

Who pays the closing costs?

We pay the seller's standard closing costs: Minnesota state deed tax (plus the environmental surcharge Hennepin and Ramsey counties add), the abstract update or title search, and title company closing fees. Your mortgage, liens, and unpaid property taxes are paid from the sale proceeds.

Do you charge a commission?

No. There's no commission on a cash sale to us. Commissions on a listing are negotiable and vary, so we compare real numbers for your house instead of quoting a percentage.

Will a cash offer be less than listing the house?

Yes, a cash offer is lower than a retail sale. For a vacant, dated house, the gap often shrinks once repairs, carrying costs, commission, and months of effort are counted. Sometimes it doesn't, and we'll say so - our team includes a licensed Minnesota real estate agent.

How do you calculate your offer?

Do we have to empty the house first?

No. Take what you want and leave the rest. We handle and pay for the cleanout, donate usable furniture and household goods where possible, and recycle or haul away the rest - including hoarding situations.

Do I need to make repairs or clean?

No. We buy houses in any condition with no repairs, cleaning, staging, or showings.

Can you buy a house that's still in probate?

Yes. We work with the estate's attorney and the title company. In general, a personal representative needs letters testamentary or letters of administration before selling, and informal probate is usually faster than formal probate. Your probate attorney confirms what applies.

What if the house has a Transfer on Death Deed?

A home with a recorded TODD may pass without probate. The beneficiary typically records a certificate of death and an affidavit before selling. We coordinate with the title company; your attorney confirms the steps.

Do my tenants have to move out before you buy?

No. We buy with tenants in place, and existing leases carry over with the sale.

Can we sell the house before our divorce is final?

Often, yes, when both owners sign and no court order prevents it. Both of you see the same written offer, and the title company splits proceeds per your agreement. Your attorneys confirm what's allowed.

Will selling Mom's house affect Medical Assistance?

We can't advise on that, and a sale does not help anyone qualify. Minnesota Medical Assistance has a 60-month lookback, and a sale below fair market value can be treated as a transfer for less than value with a penalty period. Talk with an elder law attorney before selling.

Can the state have a claim against an inherited house?

Possibly. If the deceased owner received Medical Assistance, the state may have an estate recovery claim against the home. Ask the estate's attorney before assuming the proceeds are yours.

Can you stop my foreclosure?

No one should promise that. Minnesota mostly uses foreclosure by advertisement, followed by a redemption period after the sheriff's sale - typically six months for most homeowners. Selling before the sale date can protect equity and credit. Talk with an attorney or HUD-approved housing counselor about all your options.

Minneapolis and St. Paul require a Truth-in-Sale of Housing evaluation before most home sales, and some other Minnesota cities run their own time-of-sale programs. When we buy, we arrange and pay for any required TISH evaluation or septic compliance inspection.

Will you buy a Duluth house with ice dam or burst-pipe damage?

Yes. Duluth's older homes on steep lots see frequent ice dam and water damage in hard winters, and we buy them as-is. Stop the water and call your insurer first; then we'll walk the house and price repairs into the offer.
